Pittsburgh Attorney Lends His Expertise to Global Legal Issues

Bob Bernstein Travels to China to Discuss Creditors' Rights and Bankruptcy Law with Two Organizations

We tend to think of globalization in terms of importing, exporting, and manufacturing. But international transactions also bring with them international legal issues. That's why Bob Bernstein, managing partner of Bernstein Law Firm, recently traveled to Beijing, China, to speak before two prominent organizations on the subjects of creditors' rights and bankruptcy.

On May 9 and 10, 2005, he presented to members of China Export and Credit Insurance Corporation-China's only official export credit insurance company and one of Bernstein's clients-and Jincheng & Tongda Law Firm, among China's largest law firms. Each seminar presentation began with a history of Pittsburgh and the surrounding region and segued into a thorough overview of how the U.S. legal system affects business. Bernstein's goal in the presentations was to better acquaint his audience with ways that sellers and creditors can better protect themselves and avoid credit losses in the United States.

Bernstein addressed a variety of specific issues in the areas of creditors' rights and bankruptcy, including:

  • How U.S. bankruptcy law can affect foreign creditors and vendors
  • The new bankruptcy laws, many of which are effective in October 2005
  • Chapter 11 plan process and how creditors can participate
    The difference between federal and state credit laws
    The "3 Cs" of Credit: Character, Capacity, and Capital
  • Debt recovery and collection
  • Repossession of property
  • The American Board of Certification and its certification of bankruptcy and creditors' rights attorneys
